Massachusetts Updates Zoning Act to Streamline Housing and Development

Governor Maura Healey has signed significant amendments to the Massachusetts Zoning Act as part of the FY2027 state budget. Effective July 9, 2026, the changes are intended to modernize the permitting process, reduce unnecessary barriers to development, and provide municipalities with greater flexibility when reviewing projects.

While each project remains subject to local zoning bylaws and review processes, several of these changes could affect how residential projects move through permitting.

These changes are the result of the advocacy efforts of the Home Builders & Remodelers Association of Massachusetts (HBRAMA), which HBRACC members are members of thru our 3-in-1 membership model. 

Greater Flexibility for Variances

One of the most significant changes involves variances under Chapter 40A, Section 10.

Previously, Massachusetts law required applicants to satisfy a narrow hardship standard tied to the property's soil conditions, shape, or topography. The revised law instead allows permit granting authorities to determine whether strict enforcement of a zoning bylaw would create a practical difficulty. In making that determination, boards may weigh both the benefits to the applicant and the public interest—including the interest in supporting housing production—against any impacts on public health, safety, and neighborhood welfare. Boards may also consider factors such as financial hardship, whether another feasible solution exists, and whether the hardship was self-created.

The legislation also allows residential use variances unless prohibited by local ordinance or bylaw and extends the period for exercising a granted variance from one year to two years, with additional time excluded while other required permits or appeals are pending.

Easier Improvements to Certain Nonconforming Homes

The amendments also expand protections for many pre-existing nonconforming residential structures.

If a home is nonconforming because of lot size, lot shape, frontage, lot coverage, or floor area ratio, owners may now extend or alter that structure as of right, without obtaining the traditional finding from the special permit granting authority, provided the proposed work complies with the current zoning requirements for height, number of stories, and setbacks.

This change has the potential to reduce permitting costs and delays for many additions, renovations, and reconstruction projects on undersized or otherwise nonconforming residential lots.

Longer Protection from Future Zoning Changes

The legislation also expands the statutory zoning freeze.

Rather than tying protection primarily to the issuance of a building permit or special permit, approved projects now receive a 24-month zoning freeze based on the date of any Chapter 40A entitlement. The new timeline is intended to provide additional certainty while developers secure financing and complete pre-construction work before breaking ground.

Modernized Notice Requirements

The law also updates how municipalities may provide required public notices.

Communities are now permitted to send notices for zoning amendments, variances, and special permits electronically, in addition to traditional mailed notices, providing greater flexibility in how public hearing notices are delivered.

What This Means for HBRACC Members

These statewide changes are intended to improve predictability and remove some of the procedural hurdles that have complicated residential development across Massachusetts.

For builders and remodelers, the practical impacts may include:

  • More flexible standards when seeking a variance.
  • Expanded opportunities to improve certain nonconforming homes without additional special permit findings.
  • Greater certainty during pre-construction through a longer zoning freeze.
  • Modernized notice procedures for local public hearings.

As always, local zoning bylaws still govern development within each community, and municipalities will continue administering their own permitting processes. These statutory changes establish a new statewide framework that local boards will now begin applying.
